This section empowers the Governer to appoint three persons, two
of whom must be commercial men, to act as assessors upon appeals
to the Governor in Council.

Section 5 provides for the medical examination, which is to
precede the appearance before the tribunal. It is intended
that this medical examination will be conducted entirely by the
military medical authorities. It is intended to appoint as
Proper Authority the Captain Superintendent of Police, as he is
the person in charge of the register compiled under the Registra-
tion of Persons Ordinance, 1916, Ordinance No. 6 of 1916. His
department also has the most convenient machinery for carrying
out the calling up process. It was necessary to draft this
section and the following section in a permissive form, because of
the intention to call up only persons of pure European descent.

Section 6 deals with the appearance before the tribunal, and
with the powers of the tribunal to grant exemption.
Two ques-
tions arising on this section were the subject of much discussion.
These two questions are dealt with below in separate paragraphs.
The exemption clauses were passed-based generally on section 2 of
the Military Service Act, 1916. The ground of ill-health or
infirmity was omitted because the intention is to call before the
tribunal only men who shall have beencertified by the military
medical authorities as fit for general military service, and be-
cause it was felt to be safer and more satisfactory that the medi-
cal question should remain entirely in the hands of the military
